FREQUENTLY ASKED QUESTIONS REGARDING NAME CHANGE PROCEDURES IN ILLINOIS

(1) Is there a residency requirement for filing a name change petition in Illinois?

Answer: Yes. Pursuant to Section 21-101 of the Illinois Statutes, you must reside in Illinois for a period of six (6) months before filing a name change petition.

(2) Where is a Name Change Petition filed?

Answer: In the Circuit Court for the county in which the petitioner resides.

(3) Do separate petitions need to be filed for different members of the same family who wish to change their last names?

Answer: No. A single petition can be filed on behalf of the petition, his or spouse, and children.

(4) What is the legal standard that Illinois Courts use in deciding whether to grant name change petitions filed on behalf of minor children?

The Court must find by clear and convincing evidence that the requested name change is in best interest of the minor child.
